1. Acceptance of Terms

By accessing, using, creating an account with, or placing an order through Comicly, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you may not use our services.

You must be at least 16 years old to use Comicly. If you are under 18, you represent that you have obtained permission from a parent or legal guardian.

2. Description of Service

Comicly is a service that uses artificial intelligence and other technologies to create personalized comic books based on information, stories, photos, and other content provided by users. Comicly may offer digital products, printed products, or both.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, complete, and current information when creating an account or placing an order.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Content

You retain ownership of the photos, text, stories, names, and other content you upload to Comicly ("User Content").

By uploading User Content, you grant Comicly a limited, non-exclusive, worldwide license to use, process, reproduce, modify, and display such content solely for the purpose of generating, producing, fulfilling, delivering, and supporting your order.

This license automatically ends when fulfillment and any necessary customer support activities are completed, except where retention is required by law or for legitimate business purposes such as fraud prevention, dispute resolution, or backup systems.

5. Content Ownership and Permissions

You represent and warrant that:

  • You own or have all necessary rights, permissions, and licenses to upload and use the content you submit.
  • Your content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.
  • If you upload photos, names, likenesses, or personal information relating to another person, you have obtained any permissions or consents required to do so.
  • Your content complies with all applicable laws and regulations.

You are solely responsible for the content you upload.

6. AI-Generated Content

Comicly uses artificial intelligence to assist in creating personalized comic books.

AI-generated content may contain inaccuracies, omissions, inconsistencies, creative interpretations, or unexpected results. While we strive to provide high-quality output, we do not guarantee the accuracy, completeness, or suitability of any generated content.

Users are responsible for reviewing generated content before placing an order whenever preview functionality is available.

7. Acceptable Use

You may not upload, submit, request, or create content that:

  • Is illegal or promotes illegal activity.
  • Infringes any intellectual property rights.
  • Contains hate speech, harassment, threats, or discriminatory content.
  • Contains sexually explicit material.
  • Contains graphic violence or harmful content.
  • Violates the privacy or rights of others.
  • Contains malware, malicious code, or attempts to interfere with the operation of the service.

We reserve the right to refuse, cancel, remove, or suspend any order, account, or content that we believe violates these Terms.

8. Orders, Printing, and Shipping

Because Comicly products are personalized and custom-made, orders may only be cancelled before production begins.

Once printing or production has started, orders generally cannot be cancelled or modified.

Delivery dates and shipping estimates are provided for convenience only and are not guaranteed.

Comicly is not responsible for delays caused by shipping carriers, customs processing, weather conditions, supply chain disruptions, or other events outside our reasonable control.

9. Printing Variations

Due to the nature of printing and manufacturing, minor variations may occur, including but not limited to:

  • Color differences between screens and printed products.
  • Slight cropping or positioning variations.
  • Minor differences in paper, binding, or print alignment.

Such variations are normal and do not constitute defects.

10. Refunds, Reprints, and Damaged Orders

If your order arrives damaged, defective, contains a printing error, or differs materially from what was ordered, please contact us within 14 days of delivery at hello@comicly.co.

At our discretion, we may:

  • Reprint the product.
  • Replace the product.
  • Issue a partial or full refund.

We may request photographs or other evidence to evaluate claims.

We do not offer refunds solely because you are dissatisfied with creative, artistic, or AI-generated aspects of a personalized product.

11. Lost Shipments

If an order is lost in transit, please contact us and we will work with our fulfillment and shipping partners to investigate and determine an appropriate resolution.

12. Intellectual Property

All rights, title, and interest in Comicly's platform, website, software, technology, branding, designs, trademarks, and underlying systems remain the property of Comicly or its licensors.

Except as expressly permitted by law, you may not copy, modify, distribute, reverse engineer, or create derivative works based on Comicly's platform or services.

13. Privacy

Your use of Comicly is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

14. Disclaimer of Warranties

Comicly and its services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Comicly disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

15. Limitation of Liability

To the fullest extent permitted by law, Comicly and its affiliates, officers, employees, contractors, partners, and suppliers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the service.

In no event shall Comicly's total liability exceed the amount paid by you for the specific order giving rise to the claim.

16. Termination

We reserve the right to suspend or terminate access to the service, cancel orders, or refuse future service at our discretion, including where we believe these Terms have been violated.

17. Force Majeure

Comicly shall not be liable for any delay, interruption, or failure to perform resulting from causes beyond our reasonable control, including internet outages, technology failures, supplier disruptions, labor disputes, natural disasters, governmental actions, war, terrorism, pandemics, or transportation interruptions.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Israel.

19. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on our website with a revised "Last updated" date.

Continued use of the service following any changes constitutes acceptance of the updated Terms.
